Terms of Service
Last updated 27 October 2026
These terms are the agreement between you and Cutbite Video Editing LLC, a Florida limited liability company (“Cutbite”, “we”, “us”), for using Cutbite at https://cutbite.ai and its studio. By creating an account or using the service you agree to them and to the policies they name; our Privacy Policy explains how we handle your personal data. If you use Cutbite for a company or other organisation, you agree for it and confirm you may.
1. Who may use the service
You must be at least 18 years old and able to make a binding contract. You may not use the service if you are in a country under a United States embargo, or on a United States government list of prohibited or restricted parties. Accounts are made by invitation: you ask to join, and we may approve or decline a request for any reason.
2. Your account and workspace
Your work lives in a workspace. People join a workspace by our invitation, and each has a role in it (owner, editor or viewer) that decides what they may do. You are responsible for what happens in your account: keep your password and second sign-in step to yourself, and tell us at once at hello@cutbite.ai if you think someone else has used it. Give us accurate information and keep it up to date.
3. Your content
“Your content” is what you upload or give the service (videos, example videos for themes, pictures, clips, logos, music, notes and words) and what the service makes for you from it (edits, captions, animations, b-roll, themes, styles, exports).
You keep your rights in your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transcribe, analyse and change your content, and to have our service providers do the same, only to run, improve, secure and support the service for you and as these terms describe. This licence ends when your content is deleted, except for copies we must keep by law, copies in backups until they are overwritten, and what you shared in the public library (section 4).
You promise that you have all the rights your content needs, that using it with the service does not break the law or anyone’s rights, and that it follows our Acceptable Use Policy.
5. AI and what the service makes
Cutbite uses AI services to transcribe, write, design, find and make material for your videos (see AI and Data Processors). What it makes can be inaccurate, can resemble what others make, and is not guaranteed to be free of others’ rights. Review it before you publish. As between you and us, you own what the service makes for you from your content, to the extent the law allows; you are responsible for how you use it.
Material the service finds for you (stock clips and photos, pictures found on the web, logos) belongs to its owners and is offered under their licences: make sure you may use it before you publish (see our Copyright Policy).
6. Plans, Bites and payment
What the service makes is counted in Bites, under our Bites and Plans page. We do not take payment yet. Before we charge anything, we will publish billing terms and ask you to agree to them.
7. Our service
We own the service, its software, its design and our brand; these terms give you no rights in them beyond using the service as they allow. We may change, add or remove features, and we may set or change limits (for example, on video length, file size, storage, or what may be made each day). If you send us ideas or feedback, we may use them without any obligation to you.
8. Ending
You may stop using Cutbite at any time. To close your account, or a workspace you own, write to us at hello@cutbite.ai from the email address on your account. We may suspend or close an account, or remove content, if you break these terms or our policies, if the law requires it, or to protect the service or others. Within 30 days of an account or workspace being closed, we delete its data as our Privacy Policy describes, except music already in the public library (section 4) and what the law makes us keep; download what you want to keep first. Sections that by their nature should last after an account ends (such as 3, 4, 9, 10, 11 and 12) do.
9. No warranty
We work hard to keep Cutbite running well, but the service, and everything it makes, is provided “as is” and “as available”. To the extent the law allows, we make no promise that it will be uninterrupted, error-free or fit for a particular purpose, and we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement.
10. Limits on liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or about the service, however caused. Our total liability for all claims about the service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.
Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.
11. Your responsibility to us
To the extent the law allows, you will defend and hold harmless Cutbite Video Editing LLC and its people from claims, losses and costs (including reasonable legal fees) arising from your content, your use of the service, or your breach of these terms or of anyone’s rights.
12. Law and disputes
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Before bringing a claim, please write to us at hello@cutbite.ai so we can try to settle it. Any dispute that cannot be settled is heard in the state and federal courts located in the State of Florida, and you and we agree to their jurisdiction.
If you live in the European Union, the United Kingdom or another country whose consumer laws give you rights that cannot be taken away by contract, those rights are not affected by these terms, and you may also bring a claim in the courts where you live.
13. Changes to these terms
We may change these terms. If a change matters, we will tell you before it takes effect (for example, by email or in the studio). If you keep using Cutbite after a change takes effect, you accept it; if you do not agree, stop using the service.
14. General
These terms, with the policies they name, are the whole agreement between you and us about the service. If any part is found unenforceable, the rest stays in force. If we do not enforce a part, we do not give up the right to. You may not transfer these terms without our consent; we may transfer them with our business. Neither of us is responsible for delays caused by events beyond reasonable control.
